Can an employee challenge a misconduct punishment?

Yes. Section 165 provides a specific appeal route. A worker dissatisfied with an employer's misconduct punishment can generally appeal to the Labour Court within 35 days after receiving notice of the punishment.

An internal appeal mechanism in employment regulations can also be used where provided.
