Does the mother automatically get custody of a child?

Family Law

No. The Civil Code contains circumstances in which a child can remain with the mother, but custody should not be described as an automatic maternal right in every case.

Section 115 contains age- and circumstance-based rules, while child-protection law requires the child's best interests to be prioritized.
