Does the child's opinion matter in custody?

Family Law

Yes, in specified circumstances. Section 115 allows the opinion of a minor who has completed 10 years of age to be considered when deciding whether the child should remain with the father or mother.

The Act Relating to Children also supports child-sensitive, best-interest-based decision-making.
