Often yes, depending on the nature of the proceeding and applicable law. Many commercial civil disputes remain capable of settlement after filing.

The Arbitration Act also recognizes referral of qualifying commercial civil disputes to arbitration where the parties jointly request it.

A notable exception is a shareholder derivative action under section 140 of the Companies Act, which cannot simply be withdrawn or compromised outside the safeguards provided by the court.
