Yes. Business disputes can often be resolved through negotiation, mediation, arbitration or a negotiated settlement without a full court trial.

Main options

Negotiation: the parties negotiate directly or through representatives. Mediation: a neutral facilitator helps the parties seek voluntary settlement. Arbitration: an arbitrator or tribunal decides the dispute where a valid arbitration agreement applies. Settlement: the parties record an agreed resolution in a binding agreement.

The Arbitration Act provides that disputes covered by a written arbitration agreement are resolved according to that agreement and the Act.
