Is a court settlement legally binding?

Civil Cases & Dispute Resolution

Yes. A settlement formally recorded and certified by the court is legally binding.

Section 193 provides that once a court settlement is completed, a party generally cannot later challenge it merely because they are dissatisfied, except in relation to failure to implement the settlement or another legally recognized defect.
